Terms of Service

By accessing or using gift-wrapped.com, shop.gift-wrapped.com, or any related service operated by Giftwrapped(“we,” “us,” or “the Service”), you agree to these Terms of Service. If you do not agree, do not use the Service. Giftwrapped is operated by FloMoney LLC, a California limited liability company.

1. Definitions

• Organizer — the registered account holder who creates a Celebration Link for a Celebrant.
• Celebrant — the named natural person whose birthday is being celebrated and to whom a Giftwrapped Gift Card will be issued.
• Contributor — any person who records a video message and/or makes a monetary Contribution via a Celebration Link.
• Celebration Link — the private URL created by an Organizer for a specific Celebrant and birthday.
• Contribution — a monetary payment made by a Contributor, used to fund a Giftwrapped Gift Card.
• Giftwrapped Gift Card — closed-loop store credit issued by Giftwrapped, redeemable only at shop.gift-wrapped.com.
• Celebration Day — the calendar date of the Celebrant's birthday as entered by the Organizer.

2. The Service

Giftwrapped is a direct-to-consumer e-commerce service. Our store at shop.gift-wrapped.com sells curated birthday-themed merchandise. Our unique feature is a group-gift checkout: friends and family of a Celebrant may collectively fund a Giftwrapped Gift Card that is issued to the Celebrant on the Celebrant's birthday.

Giftwrapped is a retailer. We are not a marketplace, escrow service, fundraising platform, financial institution, or money transmitter. Giftwrapped Gift Cards are closed-loop store credit redeemable only at our own e-commerce store.

3. Eligibility

You must be at least 18 years old and a resident of the United States to create an account, organize a Celebration, make a Contribution, or redeem a Giftwrapped Gift Card. The Celebrant must be a natural person (not a business, organization, or entity) and at least 13 years old.

4. Accounts

Account creation is required for Organizers. You agree to provide accurate information, keep your credentials secure, and notify us at support@birthdayfor.com of any unauthorized use. You are responsible for all activity under your account.

5. Contributions and Gift Card Issuance

When a Contributor makes a Contribution through a Celebration Link, the Contribution is the purchase price of a portion of a Giftwrapped Gift Card. Contributions for a single Celebration Link are pooled and, on the Celebration Day, used to issue a single Giftwrapped Gift Card to the Celebrant in the aggregate amount of all pooled Contributions.

By making a Contribution, the Contributor acknowledges that the Contribution is the purchase of a portion of a Giftwrapped Gift Card to be issued to the Celebrant on the Celebration Day, that the Contribution is non-refundable except as described in Section 8, and that the Contributor's name and Contribution amount may be visible to the Celebrant and other Contributors.

By creating a Celebration Link, the Organizer represents that the Organizer has the Celebrant's actual or reasonably-implied consent to receive a birthday gift from the Celebrant's friends and family through the Service.

6. Giftwrapped Gift Cards

Giftwrapped Gift Cards are closed-loop store credit issued by Giftwrapped and redeemable only at shop.gift-wrapped.com.

• No expiration. The monetary value never expires, consistent with the federal CARD Act and California Civil Code §1749.5.
• No fees. No dormancy, inactivity, or service fees are charged against the balance.
• Cash redemption of small balances. Remaining balances under $10.00 may be redeemed for cash by emailing support@birthdayfor.com, consistent with California Civil Code §1749.5(b)(2).
• Non-transferable. Gift cards may not be resold, redeemed for cash (other than the under-$10 case), or transferred for value.
• Lost or stolen. Replacement is at our discretion if ownership can be verified.

Issuance is operated through Shopify's gift card system. Shopify's standard gift card terms apply in addition to these Terms.

7. Store Purchases at shop.gift-wrapped.com

When the Celebrant redeems a Giftwrapped Gift Card at shop.gift-wrapped.com, the redemption is a purchase from Giftwrapped (the retailer). Standard Shopify checkout applies. Shipping, returns, and product issues are governed by the store's published return policy at shop.gift-wrapped.com/policies.

If the order total exceeds the gift card balance, the Celebrant may pay the difference at checkout. If the balance exceeds the order total, the remainder stays on the gift card for future use.

8. Refunds

A Contribution is refunded automatically if (a) the Organizer cancels the Celebration Link before the Celebration Day, (b) Giftwrapped suspends the Celebration Link for a Terms violation, or (c) Giftwrapped is technically unable to issue the gift card on the Celebration Day and cannot resolve within 7 days. A Contribution may also be refunded on request, before the Celebration Day, for any reason. Refunds are issued via the original payment method and settle within 5–7 business days. After a Giftwrapped Gift Card has been issued to the Celebrant, Contribution-level refunds are generally not available because the funds are committed to honor the gift card. Store-purchase returns follow the store's return policy.

9. Disputes and Chargebacks

Please email support@birthdayfor.com first; we respond within 24 hours and resolve most issues immediately. You retain the right to dispute any payment through PayPal's or Stripe's standard process. Repeated chargebacks may result in account suspension.

10. User Content

You retain ownership of videos and messages you record. By recording them, you grant Giftwrapped and the Organizer a limited license to host, transmit, and display them to the Celebrant and other authorized viewers solely for operating the Service. Content that is unlawful, harassing, defamatory, sexually explicit, threatening, or otherwise violates these Terms may be removed without notice.

11. Prohibited Use

You may not use the Service:

• For commercial transactions outside normal store purchases.
• For fundraising for charities, causes, political campaigns, businesses, or any beneficiary other than a single named natural-person Celebrant.
• To collect Contributions for a Celebrant who has not consented (actually or reasonably-impliedly) to receiving a birthday gift through the Service.
• For money laundering, terrorist financing, fraud, or any illegal purpose.
• For adult content, gambling, controlled substances, weapons, or any activity prohibited by PayPal's or Stripe's Acceptable Use Policies.
• To impersonate any person or misrepresent your relationship with the Celebrant.
• To attempt to redeem a Giftwrapped Gift Card for cash other than as expressly permitted in Section 6.

12. Fees

Giftwrapped does not currently charge a separate platform fee on Contributions. Payment processing fees from PayPal or Stripe are deducted from each Contribution before it is added to the gift card pool, as disclosed at checkout.

13. Suspension and Termination

We may suspend or terminate your account or any Celebration Link at any time for any Terms violation or to protect the Service, our users, or third parties. Pending Contributions are refunded upon termination unless prohibited by law or an active dispute.

14. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT OF CONTRIBUTIONS OR PURCHASES YOU MADE THROUGH THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California. Any dispute will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small claims court if eligible. YOU AND GIFTWRAPPED AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.

17. Privacy

Your use of the Service is also governed by our Privacy Policy.

18. Changes

We may update these Terms at any time. Material changes will be communicated by email or by prominent notice on the Service before they take effect.
